In the online world, many intermediaries hide behind their status as ‘neutral’ hosting providers to refuse to take action in the face of flagrant breaches of the law. This is precisely what we are currently experiencing with the host of a website infringing our registered trade mark. When contacted, the platform (Automattic / WordPress) refuses to block the site as a precautionary measure, insisting on a court order.
Yet, if a host were truly neutral, its priority would be to freeze the situation pending the judgement so as not to exacerbate the damage. Keeping a disputed website online simply because the infringer is a paying customer is not neutrality; it is commercial complacency. An application for interim relief has been formally filed.
We will go to any lengths to ensure our intellectual property rights are upheld. The question remains unanswered for the digital ecosystem: how can we force the tech giants to take responsibility for tackling counterfeiting?
